Creator Hound – Terms & Conditions

By creating an account, starting a free trial, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms. If you do not agree, you must not use the Service.

If you use the Service on behalf of a company or other organization, you confirm that you have the authority to bind that organization to these Terms, and "you" refers to that organization as well as to you.

You must be at least 18 years old, or the age of majority in the place where you live if that is higher, to use the Service.

Creator Hound is a business tool for brands, agencies and marketers who want to discover social media creators for legitimate marketing collaborations. It is not intended for personal, household or consumer use, and you may not use it to monitor, profile, track or locate individuals outside of a genuine commercial outreach context.

In these Terms:

• "Account" means the account you create to access the Service.
• "Plan" means the Free plan or the paid Pro plan, as described on our Pricing page.
• "Query" means a plain-English description of the creators you are looking for that you enter into the Service.
• "Creator Data" means information about creators surfaced by the Service, such as names, handles, follower counts, niches, locations and publicly available contact email addresses.
• "Results" means the ranked matches, Creator Data, lists and exports the Service produces in response to your Queries.
• "Your Content" means the Queries, saved lists, notes and other material you submit to the Service.

Creator Hound is an AI-powered influencer search tool. You describe the creators you are looking for in plain English, and the Service ranks matching creators, and, on paid Plans, provides their outreach email addresses, saved lists and CSV exports.

We may add, change, suspend or discontinue features at any time. If we make a material reduction to a paid feature, we will give Pro subscribers reasonable advance notice by email or in the Service.

To use most features you must create an Account. You agree to:

• provide accurate, current and complete registration information and keep it up to date;
• keep your password and login credentials confidential;
• accept responsibility for all activity under your Account, whether or not you authorized it; and
• tell us promptly at hello@creatorhound.ai if you suspect unauthorized access.

Each Account is for a single individual user. You may not share your credentials, or use one Account across multiple people, unless we have agreed otherwise in writing. You may not create multiple free Accounts to get around usage limits or other restrictions.

The features, limits and prices of each Plan are described on our Pricing page, which forms part of these Terms. We may change Plan features or limits from time to time. We will not apply a price increase to an existing Pro subscription without at least 30 days' notice.

• Free plan. The Free plan is provided at no charge and is subject to the usage limits shown on the Pricing page.
• Free trial. We may offer a free trial of the Pro plan (currently 14 days). Unless you cancel before the trial ends, your Pro subscription will begin and your payment method will be charged the then-current price.
• Billing. Pro is billed monthly in advance. By subscribing, you authorize us and our payment processor to charge your payment method at the start of each billing cycle until you cancel.
• Payment processor. Payments are handled by a third-party processor. You agree to the processor's terms, and you are responsible for any fees your bank or card issuer charges.
• Taxes. Prices exclude applicable taxes, such as HST, GST or sales tax, unless stated otherwise. You are responsible for all taxes arising from your purchase.
• Failed payments. If a payment fails, we may retry it and may suspend or downgrade your Account to Free if we cannot collect payment within a reasonable time.
• Price changes. We will give you at least 30 days' notice before increasing the price of your subscription. If you keep using the Service after the new price takes effect, you accept it.

You may cancel your Pro subscription at any time from your account settings or by emailing hello@creatorhound.ai. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then. After that, your Account reverts to the Free plan.

Except where required by applicable law, fees are non-refundable once a billing cycle has begun, and we do not provide refunds or credits for partial billing periods or unused features.

You may use the Service to discover creators, plan influencer campaigns, save and organize lists, and export Results for your own internal business purposes. You must use it lawfully and in line with these Terms. You must not:

• scrape, crawl, bulk-download or systematically extract data from the Service to build a database, index or competing product;
• use any robot, spider, script or other automated means to access the Service, except through an API we have expressly made available to you;
• resell, sublicense, publish or otherwise make Results or exports available to third parties as a commercial offering;
• share or sell your Account, or use multiple Accounts to evade limits;
• harass, stalk, intimidate or build surveillance profiles on creators or any other individual;
• use Creator Data for any purpose other than genuine commercial outreach to the relevant creator;
• reverse engineer, decompile or attempt to extract the source code, prompts or underlying models of the Service;
• probe, scan or test the security of the Service, bypass access or usage controls, or interfere with its operation or place an unreasonable load on our systems;
• submit Queries or content that is unlawful, infringing, defamatory, obscene or harmful, or that attempts to manipulate the Service into producing such content;
• use the Service to send spam, to impersonate any person, or to mislead creators about who you are or why you are contacting them; or
• use the Service in any way that violates applicable law.

Creator Data is derived from information that creators have made publicly available on social media platforms and elsewhere. We have no relationship with the creators in our index, and we make no promises about their availability, willingness to collaborate, or the accuracy of their profile data.

Accuracy. Follower counts, niches, locations, email addresses and other Creator Data reflect information collected at a point in time and may be outdated, incomplete or wrong. You are responsible for verifying anything that matters before you rely on it.

Email addresses. Where the Service shows creator email addresses, you agree to:

• use them only for relevant, individual outreach about a genuine business opportunity, and not for purchased-list blasts, newsletters or automated mass messaging;
• comply with all anti-spam and privacy laws that apply to your messages, including Canada's Anti-Spam Legislation (CASL), the U.S. CAN-SPAM Act, and the GDPR and UK GDPR where relevant;
• identify yourself clearly and include a working way to opt out in your messages; and
• honour opt-out, unsubscribe and deletion requests immediately.

Creator Hound provides the discovery tool; you are the sender. We are not responsible for any message you send or any campaign you run, and you are solely responsible for compliance with the laws that apply to them.

If you are a creator and want your information removed from the Service, email hello@creatorhound.ai. We will review and act on valid requests within a reasonable time.

The Service, including its software, search and ranking technology, design, text, graphics, logos and all other content we produce, is owned by Creator Hound or its licensors and is protected by intellectual property laws. "Creator Hound" and our logos are our trade-marks, and you may not use them without our written permission.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own internal business purposes. This licence does not allow you to copy, modify or create derivative works of the Service, to remove proprietary notices, or to redistribute Results or exports outside your own organization.

You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, store and use Your Content only as needed to operate, secure and improve the Service and to provide it to you. You confirm that you have the rights needed to submit Your Content and that doing so does not violate any law or third-party right.

We may use aggregated or de-identified information about how the Service is used to understand and improve it.

If you send us suggestions or ideas about the Service, you give us a perpetual, irrevocable, royalty-free licence to use them without restriction or compensation to you.

Creator Data is sourced from public third-party platforms such as Instagram. We are not affiliated with, endorsed by or sponsored by Instagram, Meta or any other platform, and their names and marks belong to their owners. We do not own the underlying data and make no promise that your use of it complies with a platform's own terms. You are responsible for following the terms of any platform on which you contact or work with creators.

The Service may also rely on or link to third-party services, such as payment processors, hosting providers and AI model providers. Your use of those services may be governed by their own terms, and we are not responsible for their content, availability or practices.

The Service uses artificial intelligence to interpret your Queries and rank creators. AI systems can make mistakes, miss relevant creators, or return matches that do not fit your brief. Results are provided for information and research only.

You are responsible for reviewing Results and for any decision you make based on them, including whom to contact, what to offer, and how to run a campaign. We do not guarantee that any creator will respond, be suitable for your brand, or deliver any particular audience, engagement, sales or other outcome.

We may refine our ranking methods and models at any time, so the same Query may return different Results on different days.

We aim to keep the Service available, but we do not promise it will be uninterrupted, error-free or secure at all times. We may suspend access for maintenance, security or reasons outside our control. Free plan limits, such as the number of results per Query, may change over time.

Our Privacy Policy explains how we collect, use and disclose personal information, and you consent to that handling as described there. We use reasonable safeguards to protect the Service and your information, but no method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security.

You may stop using the Service and close your Account at any time. Cancelling a paid subscription does not by itself delete your Account; it moves you to the Free plan at the end of the billing period.

We may suspend or terminate your access immediately, with or without notice, if we reasonably believe you have breached these Terms, misused Creator Data, put the Service or others at risk, or if we are required to by law. If we terminate your paid subscription for your breach, we are not required to provide a refund.

When your access ends, your licence to use the Service ends. Sections that by their nature should survive termination will continue to apply, including those on intellectual property, fees owed, indemnification, disclaimers, limitation of liability and governing law.

THE SERVICE, THE RESULTS AND ALL CREATOR DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, CREATOR HOUND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE ABOVE, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT CREATOR DATA, INCLUDING FOLLOWER COUNTS, ENGAGEMENT FIGURES OR EMAIL ADDRESSES, IS ACCURATE, COMPLETE OR CURRENT; OR THAT RESULTS WILL MEET YOUR REQUIREMENTS OR PRODUCE ANY PARTICULAR OUTCOME.

TO THE FULLEST EXTENT PERMITTED BY LAW, CREATOR HOUND AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO CREATOR HOUND IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) CAD $100.

Some jurisdictions do not allow certain exclusions or limits of liability. In those places, our liability is limited to the greatest extent permitted by law, and nothing in these Terms limits any right you have that cannot be waived under applicable law.

You agree to defend, indemnify and hold harmless Creator Hound and its affiliates, owners, officers, employees and contractors from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to:

• your use of the Service in breach of these Terms or applicable law;
• any message, outreach or campaign you conduct using Creator Data, including claims under CASL, CAN-SPAM, the GDPR or other anti-spam, marketing or privacy laws;
• your misuse, redistribution or resale of Results or exports; and
• Your Content, including any claim that it infringes or violates a third party's rights.

We will promptly notify you of any claim, and you will not settle a claim in a way that imposes obligations on us without our written consent.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules.

If a dispute arises out of or relates to these Terms or the Service, we both agree to first try to resolve it in good faith through negotiation, starting with written notice sent to the contact details in Section 26. If it is not resolved within 30 days, the courts of Ontario, Canada have exclusive jurisdiction, and each of us submits to their jurisdiction. If you are a consumer who has a non-waivable right to bring a claim in your local courts, that right is not affected.

We may update these Terms from time to time. We will post the current version at https://www.creatorhound.ai/terms and update the "Last updated" date. For material changes, we will notify you by email or in the Service, where practical at least 30 days before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms. If you do not agree, you must stop using the Service before then.

• Electronic communications. You consent to receive notices and other communications from us electronically, including by email and by posting on the Service, and you agree these satisfy any legal requirement that they be in writing.
• Entire agreement. These Terms, together with the Privacy Policy and the Pricing page, are the entire agreement between you and Creator Hound about the Service. They replace any earlier understanding on the same subject.
• Severability. If any part of these Terms is found to be invalid or unenforceable, the rest remains in effect.
• No waiver. If we do not enforce a right, that is not a waiver of it.
• Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, sale of assets or by operation of law.
• Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
• Relationship. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship between us.
• Language. The parties have required that these Terms and all related documents be drawn up in English. Les parties ont exigé que les présentes conditions et tous les documents connexes soient rédigés en anglais.
